Judicial Trends in NY Favor Lenders in BPL Deficiency Actions
August 21, 2025Residents already claim to feel the impact. For example, homeowners in Willow Run, a 55+ community in Limerick, PA, received notice of a nearly 50% rent increase effective September 1, 2025. Manufactured homeowners own their units but lease the land, meaning steep rent hikes can quickly push borrowers into distress. If legislative gridlock continues and private equity owners accelerate rent adjustments, lenders and servicers should anticipate rising delinquency and foreclosure pressures in manufactured housing portfolios. These sudden cost burdens strain repayment capacity on existing loans, drive up workout requests, and increase loss-mitigation demands. Without a legislative backstop, housing instability in this sector can spread and, consequentially, compound credit risks for lenders with exposure to manufactured housing communities.
