Check out this great article written by Catherine Aponte, Senior Associate Attorney for Mid-Atlantic Operations, published in American Legal & Financial Network “ALFN”‘s Spring Publication. In what appears to be a first for NJ, the court agreed with arguments made by our attorneys that certain restrictive covenants, generally titled “MVR Homeowners Benefit Agreement”, are unreasonable and unenforceable under New Jersey’s Davidson’s Test. This was a great win for lenders and investors with assets in NJ.
