FV Senior Associate Franklin Chiu recently received a welcome, post-Kessler, order from the Queens County Supreme Court, which rejected defense arguments of non-compliance with RPAPL 1304 referencing the NY Court of Appeals’ rejection of the “bright line” rule in its recent Kessler opinion. The firm is pleased to have received this early post-Kessler ruling favorable to lenders’ rights.
