Title Insurance
Title Insurance is a form of indemnity insurance. Generally, there are two types of title insurance – Fee Simple and Mortgage. Fee Simple Insurance protects you against financial loss from title defects. Should your ownership claim come into question the Title Company will defend you in a lawsuit up to the dollar amount of insurance provided by the policy.
Mortgage Insurance protects your lender against financial loss against the invalidity of unenforceability of the mortgage lien on your property. Should the bank’s interest in the property come into question the Title Company will defend the bank in a lawsuit up to the dollar amount of insurance provided by the policy. Nearly all lenders require that the purchaser obtain Mortgage insurance to protect the lender’s interest.
