The court determined that U.S. Bank National Association had proven all required elements for foreclosure, including the existence of the note and mortgage, the borrower’s default, and the bank’s right to enforce under New Jersey law. With no genuine dispute of material fact and the borrower’s defenses rejected, the court cleared the way for U.S. Bank National Association to move directly toward a final judgment of foreclosure. This ruling streamlines U.S. Bank National Association’s path to enforcement and eliminates the delays and costs associated with trial.
This outcome demonstrates FV’s ability to deliver meaningful progress for institutional lenders through strategic motion practice and thorough case preparation.
