June 19, 2025Connecticut Enacts New 10-Year Foreclosure Deadline
June 30, 2025On June 14, 2025, Connecticut enacted Public Act No. 25-46, establishing a 10-year statute of limitations for initiating foreclosure actions on residential mortgages, effective January 1, 2026. The law bars foreclosure after the earlier of 10 years from the maturity date or from the last borrower payment, unless extended in writing. It also shortens the period for invalidating undischarged mortgages from 20 to 10 years after maturity. The law is intended to protect residential homeowners from being subject to collection activities on long dormant “Zombie Mortgages.” Exemptions apply to certain pre-2026 first lien mortgages or subordinate mortgages owned by the original mortgagee or an affiliate. Lenders and servicers should review aging loan portfolios and ensure timely enforcement and discharge practices in light of the new deadlines.
