June 18, 2024Significant Victory in CP-SRMOF II 2012-A Trust v. Turri Case in Queens County Court
In CP-SRMOF II 2012-A Trust v. Turri, et al., the Appellate Division, Second Department affirmed the Queens County Supreme Court’s decision to deny defendant Jermaine Lunsford’s motion to vacate a judgment of foreclosure and sale, and to dismiss the complaint for lack of personal jurisdiction.
Lunsford argued that he was not properly served, but the court found that the process server’s affidavits provided prima facie evidence of proper service. The court deemed the affidavits submitted by Lunsford as insufficient to rebut this presumption of valid service because they only identified minor discrepancies in the defendant’s height and weight that were insufficient to rebut the presumption..
