Pennsylvania House Bill 2141, introduced in the 2023-2024 Regular Session, aims to amend title 68 (Real and Personal Property) of the Pennsylvania Consolidated Statutes to streamline and modernize the foreclosure sale process in Pennsylvania.
The Key Provisions are as follows:
Private Selling Officer Sales: This bill would allow a creditor or party with a financial interest in the property to file a petition for an order authorizing the appointment of a specific “Private Selling Officer” (PSO) of their choosing to conduct the sale of the property. The court cannot deny the Petitioner’s desired PSO without good and reasonable cause. The PSO conducts the sale, but all other administrative responsibilities, and the right to receive a commission, remain with the Sheriff’s office. The PSO’s sole compensation and reimbursements are limited to a cumulative total of $500.00 unless a higher amount is approved by the Petitioner.
Accelerated Vacant Property Sales. Where a property is certified as vacant and abandoned, and an accelerated sale fee of $500 is paid by Plaintiff, the Sheriff or PSO is directed to schedule a sale to be conducted no later than sixty (60) days from the day the writ was entered. Further, the Sheriff deed must be recorded by thirty (30) days post-sale.
The bill is currently pending in the Commerce Committee, a crucial step in its journey. If the Committee recommends passage, it will go before the entire House of Representatives for a vote.
